The law places the paramount focus on the “best interests of the child.” We assist parents in establishing sustainable parenting plans that protect parental bonds:

  • Decision-Making Authority: Allocating sole or joint responsibility for major life decisions regarding health, education, religion, and welfare.
  • Parenting Schedules: Designing practical schedules that provide consistency for children while accommodating parental work demands.

Child Support & Spousal Support

Financial stability post-separation relies on accurate support determinations:

Child Support Calculations:

Applying the Child Support Guidelines accurately to income, including base monthly amounts and Special or Extraordinary Expenses (Section 7 expenses such as daycare, medical costs, and extracurricular activities).

Self-Employed & Complex Income Analysis:

Uncovering true earning capacity when a payor utilizes corporate dividends, write-offs, or cash flow variations.

Spousal Support Advisory Guidelines (SSAG):

TProperty division requires careful financial accounting. We navigate:

Equalization of Net Family Property (NFP):

Calculating asset growth from marriage date to separation date.

Matrimonial Home Protections:

Enforcing specific legal protections that govern the shared family residence, including exclusive possession claims.

Corporate & Pension Valuations:

Addressing private company shares, family trusts, stock options, and pension division.

Divorce

Ending a marriage involves more than a court order. It requires a clear plan for your finances, your children, and your future. We guide clients through every stage of the divorce process under the federal Divorce Act:

  • Uncontested Divorce: Preparing and filing simple or joint divorce applications when spouses agree on all terms, keeping costs and delays to a minimum.
  • Contested Divorce: Protecting your interests when spouses disagree on parenting, support, or property issues that must be resolved alongside the divorce.
  • Divorce Orders & Certificates: Managing court filings, affidavits, and service requirements through to your final Divorce Order and Certificate of Divorce.

Frequently Asked Questions (FAQ)

No. In fact, the vast majority of family law disputes are resolved without entering a courtroom. Through structured negotiation, legal disclosure, and mediation, parties can execute a binding Separation Agreement. Court filings are only required to obtain the official Divorce Order or when the parties cannot agree on custody, support, or property terms.

The matrimonial home carries a unique status under the law. Even if only one spouse holds registered title to the home on paper, both spouses generally share an equal right to possession of the property upon separation. The full value of the home is typically included in the net family property calculation without the standard deductions for pre-marriage value that apply to other assets.

Section 7 expenses go beyond basic food, clothing, and shelter covered by base table child support. They include reasonable and necessary costs such as infant daycare, private school tuition, post-secondary education fees, uninsured health and dental care, and elite-level extracurricular athletic or artistic training. These are generally shared by parents in proportion to their respective incomes.

In Canada, the standard no-fault ground for divorce is a one-year period of living separate and apart. While you can file the initial application before the full 365 days have passed, the final Divorce Order will not be granted by a judge until the one-year mark is achieved.
